JERSEY SHORE SEA KAYAK ASSOCIATION
Membership in JSSKA is open to individuals 18 years of age or older. Individuals must be 18 years of age or older to participate in JSSKA paddling trips, the JSSKA Message Board, camping trips, and events posted on the Paddlers Express Message Board.
WAIVER AND RELEASE OF LIABILITY
(IMPORTANT - READ BEFORE SIGNING!)
"Paddler's Express" is a public online message board for kayaking and related activities in New Jersey. Sea Kayaking can be a dangerous sport. JSSKA urges all participants to take ACA approved instructional courses, and to learn about safety, self-rescue, hypothermia, waterway navigation and basic USCG rules before launching on any trip. Paddlers should also be aware of current and future weather conditions and should never overestimate their abilities. I understand that I am solely responsible for my own safety and navigation at all times when participating in any and all paddling trips, events, and activities posted on the JSSKA message board and calendar. JSSKA assumes no liability.
In consideration of being allowed to participate in any way in the Jersey Shore Sea Kayak Association athletics/sports program, and related events and activities, the undersigned agrees to the following:
1. Prior to participating in any activity or event, I will inspect the facilities and equipment to be used, and if I believe anything is unsafe, I will immediately advise a coach, instructor, supervisor, or other event organizer of such condition(s) and I will refuse to participate.
2. I acknowledge and fully understand that I will be engaging in activities that involve risk of damage to personal property or serious injury, including permanent disability and death, and severe social and economic losses which might result not only from my own actions, inactions, or negligence, but the actions, inactions, or negligence of others, the rules of play, the condition of the premises, or of any equipment used. Further, there may be other risks not known or not reasonably foreseeable at this time.
3. I assume all of the foregoing risks and accept personal responsibility for all expenses, medical or otherwise, following any such damages, injury, permanent disability or death.
4. I release, waive, discharge and covenant not to sue the Jersey Shore Sea Kayak Association, its officers and trip leaders (including their heirs and next of kin), JSSKA’s affiliated clubs, their respective administrators, directors, agents, coaches, and other employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as "releasees", from any and all liability to me, my heirs and next of kin for any and all claims, demands, losses, or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise.
5. This waiver may not be modified in any way. If any part of this waiver is determined to be invalid by law, all other parts of this waiver shall remain valid and enforceable.
MESSAGE BOARD USER AGREEMENT
You agree, through your use of this JSSKA forum, that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, offensive, sexually oriented, inflammatory, threatening, invasive of a person's privacy, pertaining to illegal activity or otherwise in violation of ANY law. In doing so, legal actions can be taken against you. Any links to sites that involve the aforementioned content will be removed. Anyone posting the aforementioned content may be banned from using the message board.
You agree to treat our Message Board Users and the JSSKA Officers with respect and abstain from personal insults, name calling, baiting, or berating fellow Users and Club Officers. Disrespectful posts may be modified or removed at the discretion of the Forum Administrator and Moderators, and repeat offenders may be banned from using the message board. If you disagree with a Moderator’s actions, please communicate with the Moderator directly by private message. Posts or threads disrespecting the Moderator’s decisions are discouraged and may be removed.
You agree not to post any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material.
Aggressiveness, vulgar or offensive language, derogatory slang including racist, ethnic, religious or sexist slurs, sexual content, sexual harassment, pornography, and inappropriate images are prohibited on the message board and will be removed at the discretion of the Forum Administrator and Moderators. The offender may be banned from use of the message board. Any links to sites that involve the aforementioned inappropriate content will be removed.
Any post, User ID, Displayed Name, avatar, email address, signature, or other profile information that is considered offensive or inappropriate will be removed at the discretion of the Forum Administrator and/or Global Moderator.
Advertisements, spam, flooding, chain letters, pyramid schemes, and solicitations are also inappropriate to this JSSKA forum and will be removed.
While some affiliated groups and individuals from time to time make announcements as to classes and sales, any commercial post deemed to be inappropriate may also be modified or removed at the discretion of the Forum Administrator and/or Global Moderator. Commercial posts, advertisements and promotional information from non-affiliated sources or regarding non-kayaking related information are prohibited and may be removed.
Note that it is impossible for us to confirm the validity of posts on this JSSKA forum. Please remember that we do not actively monitor the posted messages and are not responsible for their content. We do not warrant the accuracy, completeness or usefulness of any information presented. The messages express the views of the author, not necessarily the views of the JSSKA, it's officers, or members. Anyone who feels that a posted message is objectionable is encouraged to notify an administrator of this forum immediately. We have the right to remove objectionable content, within a reasonable time frame, if we determine that removal is necessary. This is a manual process, however, so please realize that we may not be able to remove or edit particular messages immediately. This policy applies to member profile information as well.
You remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless this forum, and any related websites to this forum. We at this JSSKA forum also reserve the right to reveal your identity (or any information we have about you) in the event of a complaint or legal action arising from any information posted by you.
You have the ability, as you register, to choose your User ID and displayed name. We advise that you keep the displayed name appropriate. With this user account you are about to register, you agree to never give your password out to another member, for your protection and for validity reasons. You also agree to NEVER use another member's account to post messages or browse this forum.
After you register and log into this JSSKA forum, you can fill out a detailed profile. It is your responsibility to present clean and accurate information. Any information we deem inaccurate or vulgar will be removed.
Please note that with each post, your IP address is recorded, in the event that you need to be banned from this JSSKA forum or your ISP contacted.
